Data Supervisor Within the Scope of the Law on the Protection of Personal Data, No. 6698, on the Clarification of the Protection of Personal Data

 

This text aims to clarify, as the World Academy for Local Government and Democracy Foundation, the notion of the use and protection of personal data within the scope of the laws and regulations being enforced.

WALD resides at the address Alemdar Mahallesi, Yerebatan Caddesi, No:2 34122 Fatih/İSTANBUL as the “Data Supervisor” within the scope of the Law on the Protection of Personal Data, No. 6698, ("KVKK" or the "Law").

Within the scope of the Law, as the Data Supervisor, processes known as “data processing” are conducted in compliance with the legislations on issues such as acquiring, saving, keeping, up-dating, and classifying your personal data and sharing them with third persons and transferring them to third persons as far as the legislation allows.

 

Legal Basis to Collection of Personal Data

WALD processes personal data that have been communicated to WALD within the scope of the projects WALD supports concerning human rights, democracy, education, health and culture and all the joint works with local governing and/or on Internet sites and in all other written/oral/electronic media in compliance with the fundamental principles envisaged in the KVKK and the requirements and objectives for the processing of personal data as stated in Articles 5 and 6 of the Law.

 

The Objective and Rights of Using Personal Data

WALD participates in activities of local governments concerning the institutionalizing of democratic participatory methods and processes  and protection of human rights by supporting the projects on human rights, democracy, education, health and culture and all the joint works with local governments and all social, cultural and social studies. WALD particularly assumes effective roles in national and international projects that supports the creation of equal opportunities for women, children, youth, disabled people, refugees and all disadvantaged groups and the active participation of such persons in the society. In line with these objectives, WALD conducts information exchange, acquires information concerning the persons WALD interacts with within the scope of the projects WALD carries out and carries out the activities of WALD in the light of such information; thus, it becomes necessary that personal data be used for these objectives.

WALD can update or change your personal data whenever you want. Your personal data will be processed as envisaged by the law and the integrity codes, in connection with the processing objectives, being restricted, levelled, correct and up to date with clear, obvious and legitimate objectives.

You can use the below stated rights within the scope of Article 11 of the Law by applying to WALD, the Data Supervisor.

In accordance with these, you have the following rights:

-                      To know whether your personal data are processed,

-                      If there are processed personal data, to demand information on these,

-                      To know the purpose for processing your personal data and to know whether such data are used in compliance with the purpose,

-                      To know the third persons to whom your personal data have been transferred, to demand the correction of the mistakes in your personal data and if transfer has been made, to demand the third person correct the mistakes,

-                      If the reasons for the processing of your personal data are annulled, to demand that these data are deleted, eliminated or made anonymous, and if transfer has been made, to request that this demand is communicated to the third person,

-                      To object to an adverse conclusion as the result of processing concerning the person,

-                      In case damage occurs as a result of illegal data processing, to demand the damage within the framework of the legislations.

Your personal data that have been process will be kept until the time envisaged in the related legislations.

 

The Transfer of Your Personal Data and the Objectives of Transfer

Your personal data collected can be transferred to study partners and to public and private institutions authorized by the law by WALD in compliance with the fundamental principles envisaged by the Law within the scope of the requirements and objectives stated in Articles 8 and 9 of the Law, inline with the below stated objectives:

Planning and executing human rights policies and processes,

Conductance by our work units of the studies necessary to have the concerned persons benefit the services offered and carrying out the related processes,

Planning and executing the activities necessary for the approval, suggestion and presentation of the programmes and services by the concerned persons,

Conductance of the necessary studies by the concerned work units for the realization of the activities carried out and execution of the related work proceeds

Assurance of the legal, technical and work security of the related persons within areas of activity

 

Instances Where Your Personal Data Can Be Processed without Your Express Consent, in accordance with the KVKK

As per Article 5 of the KVKK, WALD can process your personal data acquired legally without your express consent in the following instances:

a.                  When it is expressly envisaged by the laws,

b.                  In instances where it becomes necessary to process your personal data if you can not express your consent because of factual impossibility or to protect the life or the body integrity of you or another person when your consent is not legally valid,

c.                   When it is necessary for WALD to conduct a legal obligation,

d.                  When your personal data have been publicised by you,

e.                  When data processing is necessary for the establishment, use or protection of a right,

f.                    When data processing is necessary for the legitimate interests of WALD, provided that your fundamental rights and freedoms are not damaged.
